1. Agreement to Terms

Welcome to FAME! These Terms of Service ("Terms") constitute a legally binding agreement between you and FAME ("we," "us," or "our") governing your access to and use of the FAME mobile application and all related services (collectively, the "Service").

By creating an account or using FAME, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

3.1 Age Requirement

You must be at least 16 years old to use FAME. By using the Service, you represent and warrant that you meet this age requirement. If we discover that a user is under 16, we will immediately terminate their account.

3.2 Account Registration

To access FAME's features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

3.3 Influencer Verification Requirements

To register as an Influencer on FAME, you must:

• Have a public Instagram account with at least 10,000 followers
• Provide your authentic Instagram username for verification
• Grant permission for FAME to access your public Instagram profile data
• Confirm your identity by adding a verification code to your Instagram bio (when requested)
• Maintain the minimum follower count throughout your use of the Service

FAME reserves the right to verify your Instagram account at any time and may suspend or terminate accounts that no longer meet eligibility requirements.

3.4 Establishment Verification

Establishments must provide valid business information including:

• Legal business name and type
• Physical address in Algeria
• Contact information
• Business category and description

4. Account Responsibilities

4.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Use a strong, unique password
• Not share your account with others
• Log out from shared devices
• Notify FAME immediately if you suspect unauthorized access

4.2 Account Accuracy

You must ensure all information in your profile is accurate, current, and truthful. This includes:

• Profile photos that accurately represent you or your business
• Correct contact information
• Accurate location data
• Truthful representations of your services or offerings

4.3 One Account Per User

You may only create and maintain one account on FAME. Multiple accounts by the same person or entity are prohibited and may result in account termination.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use FAME to:

• Create and maintain your profile
• Browse and apply for collaboration offers (Influencers)
• Create and manage collaboration offers (Establishments)
• Communicate with matched parties about collaborations
• Rate and review collaboration experiences
• Access your account data and settings

5.2 Prohibited Activities

You agree NOT to:

• Fraud: Provide false information, impersonate others, or create fake accounts
• Harassment: Harass, threaten, or abuse other users
• Spam: Send unsolicited messages or commercial advertisements
• Illegal Activity: Use the Service for any illegal purpose or violate any laws
• Content Violations: Upload offensive, defamatory, or inappropriate content
• System Abuse: Attempt to hack, interfere with, or damage the Service
• Scraping: Use automated tools to extract data from FAME
• Reverse Engineering: Decompile, disassemble, or reverse engineer the app
• Circumvention: Attempt to bypass verification or security measures
• Monetary Transactions: Request or offer monetary payment for collaborations (barter only)
• Off-Platform Deals: Attempt to move collaborations off the platform to avoid our terms
• Fake Engagement: Purchase fake followers, likes, or engagement metrics

5.3 Content Guidelines

All content you upload to FAME must:

• Be original or properly licensed by you
• Not infringe on intellectual property rights of others
• Not contain nudity, violence, hate speech, or illegal content
• Be relevant to your profile or collaboration offerings
• Comply with Instagram's community guidelines (for Influencers)
• Be appropriate for all ages (PG-13 equivalent)

6. Collaboration Terms

6.1 Barter-Only Platform

FAME is designed exclusively for barter collaborations where Influencers exchange content creation services for goods or services from Establishments. Monetary payments between users are strictly prohibited on the platform.

6.2 Creating Offers (Establishments)

Establishments creating offers agree to:

• Provide accurate descriptions of what is being offered
• Specify clear requirements and expectations
• Honor accepted collaborations as described
• Respond to applications in a timely manner
• Treat Influencers professionally and respectfully

6.3 Applying for Offers (Influencers)

Influencers applying for offers agree to:

• Only apply for offers they can realistically fulfill
• Provide honest information about their capabilities
• Complete collaborations as agreed upon
• Create authentic, high-quality content
• Follow Instagram's branded content policies

6.4 Collaboration Agreements

When an Establishment accepts an Influencer's application:

• Both parties are expected to fulfill their obligations
• Details should be finalized through in-app messaging
• Any disputes should be resolved professionally
• Collaboration completion must be marked in the app
• Both parties should provide honest ratings after completion

6.5 FAME's Role

Important: FAME is a platform that facilitates connections between Influencers and Establishments. We are NOT a party to any collaboration agreements. We do not:

• Guarantee the quality of services or content
• Enforce collaboration agreements
• Mediate disputes between users
• Verify the quality or authenticity of user-generated content
• Control the actions of users off the platform

7. Intellectual Property Rights

7.1 FAME's Intellectual Property

The FAME app, including its design, features, code, branding, and content, is owned by FAME and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of FAME
• Use FAME's trademarks without permission
• Remove or alter any copyright notices
• Claim ownership of FAME's intellectual property

7.2 Your Content

You retain ownership of all content you upload to FAME. However, by uploading content, you grant FAME a worldwide, non-exclusive, royalty-free license to:

• Display your content within the Service
• Store and process your content on our servers
• Use your content for service improvement and analytics (anonymized)
• Display your content to other users as part of the Service functionality

This license ends when you delete the content or close your account, except for content that has been shared with or is visible to other users (which may remain visible to those users).

7.3 Content Responsibility

You represent and warrant that:

• You own or have rights to all content you upload
• Your content does not violate any third-party rights
• You have necessary permissions to use any third-party content
• Your content complies with all applicable laws

8. Ratings and Reviews

After completing a collaboration, both parties can rate and review each other. When submitting ratings or reviews:

• Be honest and fair in your assessment
• Base reviews on actual experiences
• Avoid defamatory or offensive language
• Do not post fake or misleading reviews
• Do not attempt to manipulate ratings

FAME reserves the right to remove reviews that violate our guidelines or are suspected to be fraudulent.

9. Privacy and Data Protection

Your use of FAME is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

Key points:

• We collect data necessary to provide the Service
• We use Firebase for authentication, storage, and analytics
• We verify Instagram accounts through the EnsembleData API
• We never sell your personal information
• You can request deletion of your data at any time

10. Account Termination

10.1 Termination by You

You may close your account at any time through the app settings. Upon account closure:

• Your profile will be immediately deactivated
• Your personal data will be deleted within 30 days
• Some data may be retained as required by law
• You will lose access to all features and data

10.2 Termination by FAME

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms of Service
• Fraudulent activity or providing false information
• Harassment or abusive behavior
• Illegal activity or content
• Failure to meet eligibility requirements
• Extended period of inactivity
• Any reason we deem necessary to protect the Service or other users

10.3 Effects of Termination

Upon account termination:

• You immediately lose all access to the Service
• All licenses granted to you terminate
• You remain liable for any obligations incurred before termination
• Sections of these Terms that should survive termination will continue to apply

11. Disclaimers and Limitations of Liability

• You use FAME at your own risk
• You are responsible for evaluating the accuracy and trustworthiness of other users
• FAME does not guarantee the quality or success of collaborations

• FAME is not responsible for user conduct or content

12. Indemnification

You agree to indemnify, defend, and hold harmless FAME, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or conduct on the platform
• Your collaborations with other users

13. Dispute Resolution

13.1 User Disputes

Disputes between users (e.g., over collaboration terms) should be resolved directly between the parties. FAME is not obligated to mediate or resolve such disputes, but may choose to provide guidance at our discretion.

13.2 Disputes with FAME

For disputes with FAME:

1. Contact Us First: Attempt to resolve the issue by contacting support@fame-dz.com
2. Informal Resolution: We will work in good faith to resolve your concern
3. Formal Process: If informal resolution fails, disputes shall be resolved according to Algerian law

13.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Algeria, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this document
• Post the revised Terms in the app
• Notify you through the app or via email (for material changes)

Your continued use of FAME after changes are posted constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service and close your account.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FAME regarding the Service and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. FAME may assign these Terms without restriction.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and FAME as a result of these Terms or your use of the Service.

15.6 Third-Party Services

The Service may contain links to third-party websites or services (such as Instagram). FAME is not responsible for the content, privacy practices, or terms of service of any third-party sites or services.

15.7 Force Majeure

FAME shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, labor strikes, or internet service provider failures.

If you do not agree to these Terms, you must immediately stop using FAME and delete the app from your device.
